Retention Of Title

  • Title to the Goods shall remain vested in Crean and shall not pass to the Customer, even if the goods have been installed/fitted but remain readily identifiable and capable of being removed, until all sums due by the customer to Crean have been paid in full and received by Crean. Until title to the Goods passes:
  • Crean shall have authority to retake, sell or otherwise deal with and/or dispose of all or any part of  the Goods.
  • Crean and its agents and employees shall be entitled at any time and without the need to give notice enter upon any property upon which the Goods or any part are installed, stored, or upon which Crean reasonably believes them to be kept.
  • The customer  shall store or mark the Goods in a manner reasonably satisfactory to Crean indicating that title to the Goods remains vested in Crean.
  • The customer shall insure the Goods to their full replacement value, and arrange for Crean's interest to be noted on the policy of insurance.
  • Irrespective of whether title to the Goods remains vested in Crean, risk in the Goods shall pass to the customer upon delivery.
  • If the Customer becomes insolvent either by:
  • Having a winding up petition presented against it.
  • Passing a winding up resolution.
  • The appointment of a Receiver, Liquidator or Examiner.

Crean shall be entitled to demand payment for all work done and materials supplied immediately.

Payment

In the event of non payment all third party debt collection fees, legal costs and interest as applied under The European Communities (Late Payment in Commercial Transactions) Regulations 2012 are payable by the debtor.

Privacy policy

Crean fully respects your right to privacy, and will not collect any personal information about you on this website without your clear permission.
